This workshop is to allow legal practitioners or non-legal practitioners to understand the interpretation of various dispute resolution clauses in contract. It will provide concrete insights into the rules, practice and application of different dispute resolution clauses in contracts. Participants will be able to gain basic understanding on the terms and dispute resolution mechanisms provided under dispute resolution clauses in a contract.

What is Dispute Resolution Clause

Shannon is a disputes partner in the International Arbitration and Construction and Engineering practices. He also co-heads the Occupational, Safety and Health practice.

Shannon has experience in the entire range of dispute resolution processes including litigation, arbitration, adjudication, mediation and bespoke processes. He is an accredited arbitrator who sits on the panel of the AIAC, HKIAC and THAC. He has acted as a sole arbitrator and as counsel under UNCITRAL, SIAC, AIAC rules and in ad-hoc cases. As a mediator, he is empanelled with the Malaysian and Singaporean international mediation centres and often mediates construction, environmental and aviation disputes. He speaks regularly in domestic and international conferences, and has also authored chapters in key areas of his practice namely; Aviation and Environmental Law, Bullen & Leake Forms and Precedents Malaysia (Sweet & Maxwell, 2018 and 2020) and Annotated Statutes of Malaysia on Construction Industry Payment and Adjudication Act 2012, Occupational Safety and Health Act 1994 and Mediation Act 2012 (LexisNexis, 2019 and 2020).

How to Draft Dispute Resolution Clause

Ms. Samrith Kaur, an advocate and solicitor is the Managing Partner at Messrs. Samrith Sanjiv & Partners in Kuala Lumpur. She graduated with Bachelor’s degree in law from University of Coventry, UK; secured her Certificate of Legal Practice and Master degree in Law at University of Malaya.

She is a Fellow of the CIArb and MIArb. She was past Vice Chairman of the CIArb (Malaysian Branch (2012-2014). She was appointed as a panel of three member arbitrators for the first time in history of SEA Games during the 29th SEA Games Kuala Lumpur 2017 and currently, President of Sports Law Association Malaysia. Ms. Samrith is a Certified Mediator, an Arbitrator and Adjudicator. She is also a Domain Name Dispute Resolution Panellist with AIAC and ADNDR Centre in Hong Kong. She is also a Panellist with SIDREC. Ms. Samrith frequently delivers talks and lectures and is actively involved in providing training to several professional bodies on ADR. She has co-authored a handbook on Practice & Procedure of Mediation and published several articles in law journals and delivers talks at the conferences.
