AIADR Mediation Training Skills Course

Overall aim
This training course is dedicated to participants who are keen on expanding their knowledge in the field of mediation. This course focuses on capacity-building for professionals participating in the training, with the aim to encourage more people to use and comprehend the mechanism of mediation as a form of dispute settlement and career progression to become an accredited mediator with AIADR.

Key Learning objectives
On successful completion of this module, participants will be able to:
a) Gain an understanding of the principles of mediation.
b) Evaluate the differences between various dispute resolution forums in context
in comparison with mediation.
c) Gain an understanding of the mediation process and procedures.
d) Understand the role of international law and statutes on mediation.
e) Gain an understanding on the role of mediators, legal counsels and
representatives in the process of mediation.
f) Demonstrate practical skills in carrying out the tasks involved in preparing and
progressing a mediation, providing justice clearly and fairly and applying
appropriate rules and procedures in a mediative manner.
g) Display values on the meaning, ethics and justice pertaining to mediation.

Expected Learning Outcomes
Upon completion of the training course, the participants are expected to:
a) Developanabilitytoweighinonandselectthemostsuitableforumforadispute.
b) Draft an applicable mediation clause for domestic and international contracts.
c) Analyse different forums from cost-benefit perspectives.
d) Explain possible options available to parties when faced with conflicts leading
to disputes.
e) Explain the benefits and drawbacks of mediation in contrast with other forums
of ADR
f) Able to display skills required in different models of mediation.
g) Adequately be informed on the various stages and procedures involved in
mediation.

Duration and Delivery of the module
This module will span over 11 days. It will be delivered by way of online tutoring (via Zoom or any other video-conferencing application adequately available).
