Membership Development Committee (MDC)

The role of the MDC as delegated by GC is to develop policies, regulations, rules, standard operating procedures and guidelines as necessary to manage and supervise the functions of the Institute with respect to its membership.

MDC is tasked to develop and establish rules and procedures for review of the qualifications for membership, voting rights, the election of members, the privileges and obligations of membership of each category of membership, the designated status of the members, the issue of Empanelment Certificates, the entrance fee and subscription of members, the resignation of members, the supervision and discipline of members, and the use of initials after Members’ names in accordance with the provisions of the Membership Regulations

Dr. Navin G. Ahuja is a distinguished mediator and arbitrator at Mediation Chambers, bringing nearly two decades of extensive experience in the international sale of goods and manufacturing to his role. He holds a law degree, a Master's specializing in Alternative Dispute Resolution (ADR), and a Doctorate focusing on guerrilla tactics in international commercial arbitration. Navin is also a Visiting Professor of Law at Guangxi University.

He serves as the AIADR Special Representative to Singapore. In addition, he is the Director of Mooting and ADR Competitions at Damodaram Sanjivayya National Law University (DSNLU) in Visakhapatnam and Co-President of the Moot Alumni Association (MAA). Navin is a member of various panels, including the Presidential Panel of Arbitrators of the AIADR, contributing his expertise to the field of dispute resolution.

An accomplished author, Navin wrote the book “Taming the Guerrilla in International Commercial Arbitration: Levelling the Playing Field”, which has garnered acclaim from leading academics and practitioners. He actively contributes to the discourse in ADR through his publications and as a member of the editorial board for the International Arbitration Law Review, alongside delivering guest lectures on mooting, ADR, and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

His commitment to excellence is demonstrated by his role as a judge in various ADR moots and his success in coaching teams to achieve outstanding results. An accredited general mediator of the Hong Kong International Arbitration Centre and Hong Kong Mediation Accreditation Association Limited since 2013, Navin has also completed the advanced mediation masterclass course and has successfully guided aspiring mediators, including lawyers, law students, and professionals from diverse fields, through the accreditation process.

Sr Ho June Khai holds qualifications in Law, Quantity Surveying and Project Management. He is a qualified multi-disciplinary construction professional and building practitioner with more than 38 years of experience in project management and construction, pre and post contract administration and management, contractual claims and dispute resolution advisory and management.

Sr Ho June Khai owns a claims consultancy outfit providing specialised construction contract management and contractual advisory services. He is empanelled as an Arbitrator, Adjudicator and Mediator with the Asian International Arbitration Centre. He is also empanelled as an Arbitrator with the Malaysian Institute of Arbitrators and as an Adjudicator with the UK Adjudicators. He has been appointed as an Arbitrator and an Adjudicator for disputes under the AIAC Rules and the CIPAA Act 2012, respectively.

Charles Ho Wang Mak is a PhD Candidate in international law and a Graduate Teaching Assistant at the University of Glasgow, a Fellow of the Centre for Chinese and Comparative Law at the City University of Hong Kong, an Honorary Fellow of the Asian Institute of International Financial Law at the University of Hong Kong, and a Research Affiliate at SovereigNET, The Fletcher School, Tufts University. His research concentrates on sovereign debt restructuring and dispute resolution.

Charles has studied law at the University of Sussex in England (LL.B. (Hons.)), The Chinese University of Hong Kong (LL.M. in International Economic Law), and the City University of Hong Kong (LL.M.Arb.D.R.(with Credit)). He is a Fellow of the Chartered Institute of Arbitrators (FCIArb), the Hong Kong Institute of Arbitrators (FHKIArb), the Arbitrators and Mediators Institute of New Zealand (FAMINZ (Arb/Med)), and the Royal Asiatic Society of Great Britain and Ireland (FRAS). He is also a pioneer member of the Asian Institute of Alternative Dispute Resolution (MAIADR). He earned accreditation as a tribunal secretary at the Hong Kong International Arbitration Centre. In 2019, he was admitted as the first member of the Australian Centre for International Commercial Arbitration Tribunal Secretary Panel from both Hong Kong and Mainland China. He is available to be appointed as a tribunal secretary for international arbitrations.

A Malaysian, Mr Cheng Ho Wah @ Roland is the Managing Advocate / Proprietor of the Firm. He was admitted as an Advocate of the State of Sabah, Malaysia, on 18th February 1992. He commenced his Legal Practice under this Firm’s name, Roland Cheng & Co., in August 1993. He was conferred the award of Justice of the Peace by the State Governor of Sabah on 18th November, 2015.

Mr. Cheng obtained his Bachelor of Science in Computer Science (B.Sc(Hons)) from the University of Ottawa, Canada in 1980 and Bachelor of Laws from the University of London, England (LLB.(Hons) London) in 1988. He was admitted as a Barrister-at-law, Lincoln’s Inn in November 1990. In 2004, he obtained his Master of Laws specialising in Maritime Law from the University of London (LLM).

In June, 2014, Mr. Cheng was admitted as a Member of The Chartered Institute of Arbitrators and in February, 2015 he was awarded the Chartered Institute of Arbitrators’ Diploma in International Arbitration. He became a Fellow of the Institute (FCIArb) on 14th April 2015. He was appointed as a member of the Panel of Adjudicators of the Asian International Arbitration Centre (formerly known as Kuala Lumpur Regional Centre for Arbitration) on 1st July 2014. He is a member of the Sabah Law Association since 1993 as well as its successor umbrella body-the Sabah Law Society from 1st January, 2018 onwards. He is also a member of the Malaysian Maritime Law Association since September 2014. He is a Fellow (Pioneer Member) since 3rd September 2018 of the Asian Institute of Alternative Dispute Resolution (AIADR). He was appointed as one of the Committee Members of the Membership Development Committee for a 2 year term 2020 until 2022 of AIADR. Then on 21st December 2020, Mr Cheng was admitted as a Member of The Society of Construction Law Malaysia (SCL).

To-date, Mr. Cheng has more than 25 years experience in handling both conventional and Islamic bank loan documentations, banking related matters, conveyancing, land related documents and estates cases. He also handles civil and criminal litigation and has acted in cases in High Court, Court of Appeal and the Federal Court.

Prior to commencing his legal practice in 1993, he has 9 years experience in Banking & finance and 4 years experience in the motor industry.

In recent years, he has been appointed as legal advisor by many companies in land matters. He is currently the legal Advisor to a number of the Associations including- Federation of Sabah Industries, Kota Kinabalu Chinese Chamber of Commerce and Industry, Sabah Builders Association, Min Sin Shea Club, Sabah Kidney Association.

AIADR is the membership based Institute and its members are committed to the AIADR Mission, Mission, Values and Code of Ethics. The members of the Institute will determine the directions and future of the Institute.

The Institute as a membership organisation invites and welcomes all elite professionals from across the globe, to join as individuals or corporate organisations, from a broad range of industries and segments of the economy, with added qualifications, knowledge and experience in legal forums and dispute resolution practices.

In accordance with the AIADR Membership Regulations, the Applicants seeking to become members of the Institute must satisfy the prerequisites of membership set out in these Regulations.

The interested persons, institutions or body corporate shall be able to apply for or be awarded with membership of the Institute. As an individual, generally the applicant would have:

  • passed the designated course(s)/Module(s) as prescribed by these Regulations; or such course(s)/Module(s) which in the opinion of the Council is equivalent to the Course(s)/ Module(s) so prescribed by the Council, and may be treated as having passed such prescribed Course(s)/Module(s) by the Council; or has met the criteria for corporate membership or institutional membership or of supporting organization, as described in these Regulations;
  • undertaken such period of relevant experience in ADR or other related fields, as provided in these Regulations; and
  • Satisfied such other requirements as to its suitability for admission to the register of membership of the Institute.

General Eligibility Criteria for All Grades of Membership

The following mandatory requirements are applicable for all grades of membership of the Institute:

  • Natural persons of sound mind and noble character
  • Must not be an undischarged bankrupt
  • Must not be under any criminal investigation or serving criminal sentence at the time of application
  • Should not be an expelled member of any other institute in the world, on disciplinary grounds
  • Committed to the AIADR Vision, Mission, Values and Code of Ethics
