Membership Development Committee (MDC)

The role of the MDC as delegated by GC is to develop policies, regulations, rules, standard operating procedures and guidelines as necessary to manage and supervise the functions of the Institute with respect to its membership.

MDC is tasked to develop and establish rules and procedures for review of the qualifications for membership, voting rights, the election of members, the privileges and obligations of membership of each category of membership, the designated status of the members, the issue of Empanelment Certificates, the entrance fee and subscription of members, the resignation of members, the supervision and discipline of members, and the use of initials after Members’ names in accordance with the provisions of the Membership Regulations

Mr. Ankit’s focus area of practice is in construction law and he has handled significant assignments involving energy projects, engineering projects and infrastructure projects for both local and foreign clients. Mr. Ankit’s legal experience has enabled him to provide professional legal advice to his clients in respect of building and construction projects in Malaysia from its inception, right up to its completion. He has conducted document review for clients, provided advice and drafted agreements for employers, developers, contractors, sub-contractors, vendors, purchasers and tenants on various aspects of commercial, retail and residential construction projects in Malaysia.

Mr. Ankit also advices clients on the legal requirements that are to be complied with at the initial stages of planning and his range of advice includes procurement strategies, project risk management and claims and dispute management or avoidance. In the event formal dispute resolution becomes a necessity, he has the experience to advice you on the appropriate dispute resolution forum. Mr. Ankit’s experience includes, mediation, adjudication, arbitration, litigation, expert determination and early neutral evaluation, amongst others..

Mr. Ankit has represented a number of multi-national and GLC’s in Malaysia as lead counsel at all levels of the Malaysian Courts. He also often represents clients in adjudication and arbitration proceedings in respect of disputes that concern claims and/or payment issues, issues in respect of termination of contract, issues concerning delays, issues concerning performance bonds, issues concerning defects rectification and issues in regard to liquidated damages, amongst others. He is also a certified adjudicator with the AIAC and he is currently pursuing an MSc in Construction Law and Dispute Resolution at King’s College London.

Sr Ho June Khai holds qualifications in Law, Quantity Surveying and Project Management. He is a qualified multi-disciplinary construction professional and building practitioner with more than 38 years of experience in project management and construction, pre and post contract administration and management, contractual claims and dispute resolution advisory and management.

Sr Ho June Khai owns a claims consultancy outfit providing specialised construction contract management and contractual advisory services. He is empanelled as an Arbitrator, Adjudicator and Mediator with the Asian International Arbitration Centre. He is also empanelled as an Arbitrator with the Malaysian Institute of Arbitrators and as an Adjudicator with the UK Adjudicators. He has been appointed as an Arbitrator and an Adjudicator for disputes under the AIAC Rules and the CIPAA Act 2012, respectively.

Charles Ho Wang Mak is a PhD Candidate in international law and a Graduate Teaching Assistant at the University of Glasgow, a Fellow of the Centre for Chinese and Comparative Law at the City University of Hong Kong, an Honorary Fellow of the Asian Institute of International Financial Law at the University of Hong Kong, and a Research Affiliate at SovereigNET, The Fletcher School, Tufts University. His research concentrates on sovereign debt restructuring and dispute resolution.

Charles has studied law at the University of Sussex in England (LL.B. (Hons.)), The Chinese University of Hong Kong (LL.M. in International Economic Law), and the City University of Hong Kong (LL.M.Arb.D.R.(with Credit)). He is a Fellow of the Chartered Institute of Arbitrators (FCIArb), the Hong Kong Institute of Arbitrators (FHKIArb), the Arbitrators and Mediators Institute of New Zealand (FAMINZ (Arb/Med)), and the Royal Asiatic Society of Great Britain and Ireland (FRAS). He is also a pioneer member of the Asian Institute of Alternative Dispute Resolution (MAIADR). He earned accreditation as a tribunal secretary at the Hong Kong International Arbitration Centre. In 2019, he was admitted as the first member of the Australian Centre for International Commercial Arbitration Tribunal Secretary Panel from both Hong Kong and Mainland China. He is available to be appointed as a tribunal secretary for international arbitrations.

Shashank Garg is an arbitrator and seasoned dispute resolution practitioner skilled in international commercial arbitration, sports arbitration, construction arbitration, mediation, and litigation having represented clients in ad-hoc and institutional arbitrations under leading institutional rules.

He is the Joint Secretary of the Society for Construction Law, India and Co-Chairs their Young Leaders Group, He is a member of the ICC Commission on Arbitration and ADR, and Member, Arbitration Committee, Delhi International Arbitration Centre (New Delhi). From 2017-19, he was ICC YAF’s ‘Regional Chapter Coordinator (India)’.

A widely published author, he is the Editor of the book “Alternative Dispute Resolution: The Indian Perspective” (Oxford University Press). Press and has also authored a book titled ‘Tourism Law in India’ published by Universal Law Publishing Co. Recently, he has coauthored a chapter with Prof. Martin Hunter in the ‘Handbook on International Arbitration’ published by Wolters Kluwer.

He is a visiting faculty at various renowned law schools in the country and is regularly invited as a speaker at dispute resolution events across the globe.

David Bateson is a leading international arbitrator who has been involved in over 200 arbitrations in Asia, Europe, the Middle East and South America. He has acted as Chairman, party-appointed arbitrator, or sole arbitrator in arbitrations under the rules of the AIAC, BANI, CIETAC, DIAC, KCAB,HKIAC,, LCIA,ICC, PCA, SIAC and VIAC, or in ad hoc arbitrations.

He has extensive experience in disputes in a variety of industry sectors including, construction, resources, commodities, insurance, joint ventures, shareholder agreements, shipping and telecommunications , and investor state.

Chambers Asia variously described him as “pre-eminent and widely experienced ,one of the top arbitrators in the region” who is “excellent at pretty much everything he is doing “an accomplished arbitrator, who is getting more and more cases in Asia, and worldwide”. and “a very good arbitrator, writing a very good award, well able to control an arbitration and culturally sensitive“.

He is listed in Chambers Most In Demand Arbitrators in Asia and Singapore.

He has over 40 years of legal experience and is a specialist in all forms of dispute resolution including arbitration, litigation and alternative dispute resolution. He has been resident in Asia since 1980, and before that he lived in Africa, Fiji and New Zealand. He is now based in Singapore.

A Malaysian, Mr Cheng Ho Wah @ Roland is the Managing Advocate / Proprietor of the Firm. He was admitted as an Advocate of the State of Sabah, Malaysia, on 18th February 1992. He commenced his Legal Practice under this Firm’s name, Roland Cheng & Co., in August 1993. He was conferred the award of Justice of the Peace by the State Governor of Sabah on 18th November, 2015.

Mr. Cheng obtained his Bachelor of Science in Computer Science (B.Sc(Hons)) from the University of Ottawa, Canada in 1980 and Bachelor of Laws from the University of London, England (LLB.(Hons) London) in 1988. He was admitted as a Barrister-at-law, Lincoln’s Inn in November 1990. In 2004, he obtained his Master of Laws specialising in Maritime Law from the University of London (LLM).

In June, 2014, Mr. Cheng was admitted as a Member of The Chartered Institute of Arbitrators and in February, 2015 he was awarded the Chartered Institute of Arbitrators’ Diploma in International Arbitration. He became a Fellow of the Institute (FCIArb) on 14th April 2015. He was appointed as a member of the Panel of Adjudicators of the Asian International Arbitration Centre (formerly known as Kuala Lumpur Regional Centre for Arbitration) on 1st July 2014. He is a member of the Sabah Law Association since 1993 as well as its successor umbrella body-the Sabah Law Society from 1st January, 2018 onwards. He is also a member of the Malaysian Maritime Law Association since September 2014. He is a Fellow (Pioneer Member) since 3rd September 2018 of the Asian Institute of Alternative Dispute Resolution (AIADR). He was appointed as one of the Committee Members of the Membership Development Committee for a 2 year term 2020 until 2022 of AIADR. Then on 21st December 2020, Mr Cheng was admitted as a Member of The Society of Construction Law Malaysia (SCL).

To-date, Mr. Cheng has more than 25 years experience in handling both conventional and Islamic bank loan documentations, banking related matters, conveyancing, land related documents and estates cases. He also handles civil and criminal litigation and has acted in cases in High Court, Court of Appeal and the Federal Court.

Prior to commencing his legal practice in 1993, he has 9 years experience in Banking & finance and 4 years experience in the motor industry.

In recent years, he has been appointed as legal advisor by many companies in land matters. He is currently the legal Advisor to a number of the Associations including- Federation of Sabah Industries, Kota Kinabalu Chinese Chamber of Commerce and Industry, Sabah Builders Association, Min Sin Shea Club, Sabah Kidney Association.

In accordance with the AIADR Membership Regulations, the Applicants seeking to become members of the Institute must satisfy the prerequisites of membership set out in these Regulations.

The interested persons, institutions or body corporate shall be able to apply for or be awarded with membership of the Institute. As an individual, generally the applicant would have:

  • passed the designated course(s)/Module(s) as prescribed by these Regulations; or such course(s)/Module(s) which in the opinion of the Council is equivalent to the Course(s)/ Module(s) so prescribed by the Council, and may be treated as having passed such prescribed Course(s)/Module(s) by the Council; or has met the criteria for corporate membership or institutional membership or of supporting organization, as described in these Regulations;
  • undertaken such period of relevant experience in ADR or other related fields, as provided in these Regulations; and
  • Satisfied such other requirements as to its suitability for admission to the register of membership of the Institute.

General Eligibility Criteria for All Grades of Membership

The following mandatory requirements are applicable for all grades of membership of the Institute:

  • Natural persons of sound mind and noble character
  • Must not be an undischarged bankrupt
  • Must not be under any criminal investigation or serving criminal sentence at the time of application
  • Should not be an expelled member of any other institute in the world, on disciplinary grounds
  • Committed to the AIADR Vision, Mission, Values and Code of Ethics
